Article 2 — Purpose
These terms of sale (‘Terms of Sale’) inform the public, in accordance with articles L. 111-1 and L. 221-5 of the French Consumer Code, that no sale of Kayzen VPN is taking place to date, and describe the framework that will apply to the paid tier.
Article 3 — Free tier
The free tier, once open, will be provided without financial consideration and without advertising. Its limits are published on the ‘Free tier’ page. It does not constitute a sale.
Article 4 — Future paid tier
The paid tier will be governed by specific terms, brought to your attention and expressly accepted before any order. They will specify in particular the price including all taxes, the payment methods, the duration, renewal, the arrangements for online cancellation and the statutory guarantees. No payment will be requested before they are published.
Article 5 — Right of withdrawal
As no sale has been concluded, the right of withdrawal is not applicable. For any future distance sale to a consumer, the consumer will have 14 days to withdraw (art. L. 221-18 of the French Consumer Code), subject to statutory exceptions, on the terms then communicated to them with a model withdrawal form.
Article 6 — Statutory guarantees
For any future sale to a consumer, the publisher will be bound by the statutory guarantee of conformity of digital content and digital services (art. L. 224-25-12 et seq. of the French Consumer Code).
Article 7 — Complaints and mediation
Any complaint may be sent to contact@kayzen-lyon.fr or by post to the registered office. The consumer will be able to use a consumer mediator free of charge (art. L. 612-1 et seq. of the French Consumer Code). The mediator will be appointed and their contact details published here before any marketing begins.
Article 8 — Governing law
The Terms of Sale are governed by French law. Failing amicable resolution, disputes fall within the jurisdiction of the competent courts of Lyon, subject to the mandatory provisions applicable to consumers.
